Terms of service
Terms for accounts, customer data, accounting software, billing, and professional services.
About Forty Two Six and these terms
Forty Two Six is wholly owned by Timothy LeGendre CPA LLC, based in Florida. These terms describe the rules for using the Forty Two Six website, accounting software, workspaces, exports, API, MCP, and related support.
Questions about these terms, legal matters, or support may be sent to [email protected].
Accounts, membership, and security
Provide accurate account information and keep access to your email, authentication methods, devices, and recovery channels secure. You are responsible for activity performed through your account unless applicable law provides otherwise. Notify [email protected] promptly if you suspect unauthorized access.
A workspace owner controls invitations and member roles. Members may see and work with sensitive company and financial records. Owners are responsible for inviting only authorized people, choosing appropriate access, reviewing membership, and removing access when it is no longer needed. Each person should use their own account rather than share authentication codes, sessions, or API keys.
Customer data and permission to process it
You retain your rights in the information and documents you or your authorized members provide to Forty Two Six (“Customer Data”). You represent that you have the rights, notices, permissions, and lawful basis needed to provide, use, and direct the processing of Customer Data, including records about customers, vendors, employees, owners, and other people.
You give Forty Two Six and its service providers a limited permission to host, copy, transmit, organize, calculate from, display, protect, back up, export, and otherwise process Customer Data only as reasonably needed to provide, secure, support, and maintain the service, follow your directions, meet legal obligations, and enforce applicable agreements. This permission lasts only as long as those purposes require.
Financial inputs and your review
Forty Two Six helps organize bookkeeping inputs and produce accounting records and reports. Results depend on the completeness, accuracy, classification, dates, settings, and instructions supplied by you and your authorized users. You are responsible for reviewing transactions, categorizations, reconciliations, journal entries, reports, exports, and other results before relying on them or providing them to another person.
The software is not a bank, payment account, tax filing service, audit, or independent verification of the records you provide. Unless a separate written engagement says otherwise, you remain responsible for maintaining source documents, meeting filing and payment deadlines, making business decisions, and obtaining legal, tax, investment, or other professional advice appropriate to your circumstances.
Software and separately agreed CPA services
Using Forty Two Six software or receiving ordinary product support does not by itself create a CPA-client, accountant-client, fiduciary, legal, tax-advisory, audit, assurance, or other professional relationship. Product descriptions and software-generated information are general service information, not a professional opinion about your specific circumstances.
An Operated bookkeeping service or another service from Timothy LeGendre CPA LLC requires a separate agreement that defines its scope, responsibilities, fees, and other terms. If that agreement conflicts with these terms about the professional service, the separate agreement controls for that service. It does not silently change the rules for unrelated use of the software.
Plans and billing channels
Self-service subscription checkout uses Stripe when enabled. The plan, price, billing timing, taxes, cancellation terms, and other purchase details presented in the order or checkout flow apply to that purchase.
All existing bookkeeping clients continue to be billed externally through Anchor, and all new $500 Operated clients are billed externally through Anchor under separate agreements. Self-service billing is separate from Anchor billing, and Anchor is not integrated into the Forty Two Six application. App access does not replace, amend, or reprice an existing agreement.
If a self-service renewal payment fails, the workspace immediately enters read-only recovery. Existing books remain readable, while changes to the books, new invitations or members, API or MCP access, and automations are unavailable until payment is resolved. A customer-initiated self-service cancellation takes effect at the end of the paid term, so access continues through that date.
Third-party services and user-directed connections
Forty Two Six relies on third-party infrastructure and authentication services, including Supabase and Google, and may make payment or other connections available. A third-party service is governed by its own terms and privacy practices, and Forty Two Six is not responsible for a third party’s systems or independent handling of information except to the extent applicable law provides otherwise.
You can create a key and connect a compatible outside client that can read the workspace information you authorize. If you create a key, connect a client, download an export, or otherwise direct information to a third party, you are responsible for choosing and authorizing that recipient, protecting credentials and exported files, and revoking access when it should end. The platform sends authorized data to the client you choose; it does not invoke AI or another model to process that data.
Provider-mapping capabilities or references in the software do not mean that a bank, accounting platform, or other provider connection is currently available. The service will identify connections that are actually enabled.
Exports, account closure, and retained records
Forty Two Six offers an Excel export of each book (chart of accounts, journal entries and lines, bank transactions and trial balance) and CSV exports of selected records. Uploaded documents, rules and settings are not part of the export. Export what you need before requesting closure. To request account or workspace closure, contact [email protected]; complete self-service deletion is not currently available.
After closure, access may end and data may be deleted or de-identified, but some information may be retained when reasonably needed for accounting or audit history, backups, security, fraud prevention, dispute resolution, tax or legal obligations, or protection of legal rights. Closure does not require alteration of an accurate audit record or records another authorized workspace member is entitled to retain.
Acceptable use
You may not use the service to:
- Break the law, violate another person’s rights, or handle information you are not authorized to use.
- Upload malware or harmful code; attempt unauthorized access; probe, scan, disrupt, or overload the service; or bypass access, rate, security, or plan controls.
- Share authentication codes or credentials, impersonate another person, misrepresent your authority, or use an API key outside the workspace and purpose for which it was authorized.
- Copy, resell, reverse engineer, or exploit the service except as applicable law expressly permits, or remove proprietary notices from the service.
- Use the service in a way that materially interferes with another customer’s use or with the integrity, security, or operation of Forty Two Six.
Ownership of the service
Forty Two Six and its licensors retain their rights in the software, website, branding, documentation, and service technology. These terms do not transfer ownership of those materials or of Customer Data. Subject to these terms and payment obligations, you receive a limited, non-exclusive, non-transferable right to use the service for your internal business or personal accounting purposes.
If you send feedback or suggestions, you permit Forty Two Six to use them without an obligation to implement or compensate for them, provided that doing so does not grant rights in your confidential Customer Data.
Availability, changes, and errors
The service may change as it develops and may occasionally be unavailable because of maintenance, security work, provider outages, or events outside reasonable control. Features identified as planned, disabled, preview, or not yet enabled are not commitments that they will be delivered by a particular date.
The service may experience errors or interruptions. You are responsible for reviewing results and maintaining exports or source records appropriate to your needs. Forty Two Six may correct errors as the service develops.
Responsibility and applicable-law rights
Each party remains responsible for its conduct under applicable law. You are responsible for the accuracy and completeness of Customer Data, decisions made from service results, access granted by your authorized users, and outside clients or services you choose to connect.
Nothing in these terms excludes, limits, or waives a right or responsibility that applicable law does not allow the parties to exclude, limit, or waive.
